Our Terms & Conditions are applicable for all photography bookings. By paying a booking fee you are agreeing to all of the terms below. If you are unsure of anything, or would like further information about these terms, please enquire at any time. Anna Fraczak Photography reserves the right to change these Terms & Conditions at any time. 

Copyright and Ownership: The copyright and all other rights in the Photos shall be retained by Anna Fraczak Photography, trading as Anna Fraczak Photography LLC (the “Photographer”). Client reserves the right to post images on social networking sites such as Facebook, Twitter, Instagram, etc. Please do not crop/hide Anna Fraczak Photography logo. There will be limited copyright ownership of the images delivered under these conditions:Commercial use of these photos is prohibited. These images are for personal use only, and may be reproduced for the purpose of sharing with friends and family. ln the event that these photos will be published, sold for profit, used within marketing materials the client must obtain written permission form and compensate studio prior to the release. Additional contract will be needed at that time.

Booking : The best time to book a Newborn Session is before the birth to enable time to be reserved around the due date. Babies rarely arrive on time, so it is important that the Photographer be contacted as soon as possible after the birth to confirm the actual booking date. 

The booking fee is non-refundable: $50 will be required to secure your booking; In the event that a Client cannot attend the session they have booked, and they have not rescheduled in advance, the booking fee is not returned to the Client but is taken as damages to the Photographer.

Pricing & Payment: Anna Fraczak Photography reserve the right to adjust prices at any time without prior notice. All prices are $ US dollars (USD). If prices of additional items have increased since the client booked their session, they will only pay the prices at the time of booking. The remaining balance payment can be made by check, cash or Venmo on the day of the session.

Cancellation: If the Photographer has to cancel the appointment, an alternative date will be offered where possible. Where not possible, the Photographer’s liability shall be limited to a full refund of the booking fee. At least 5 days notice is required for Client cancellations. An alternative date will be offered where possible, but cannot be guaranteed. The Photographer completely understands that illnesses can develop suddenly. For this reason, should a session be cancelled with less than 5 days notice due to sickness, an alternative date will be offered where possible. Only two cancellations with less than 5 days notice are allowed before the session fee is retained. 

Model Release: This contract serves as a model release giving the Photographer the irrevocable right to use the Photographs in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. Please contact me via email ([email protected]) if you do not agree with this Model Release note.

Post - Session sneak peeks: Client understands and acknowledges that post-session sneak peeks posted to any social media outlet are a courtesy. They are not to be re-edited. Client may option to not have sneak peeks posted to social media, and must make Anna Fraczak Photography aware of this prior to the end of the session.

Proof Galleries: These contain low quality, unedited proof images. These images must not be copied, screen shot, downloaded, edited, used on social media, or altered in any way. The proofs are small JPEG files, and their only purpose is for the proof gallery - the final images are processed from high quality RAW files. You may share your proof gallery link with friends and family at your own discretion. Images not ordered within two weeks of completion will be deleted, unless the Client requests an extension in writing. The digital files of all images purchased will be archived. 

Editing: Anna Fraczak Photography may capture many images during your session, but client will see only those images carefully selected by the photographer to ensure it aligns with the photographer creative style. Each image is hand edited by Anna Fraczak to the best of her ability. Any additional editing request after the images are delivered will result in additional charges, as well as additional editing/processing time will be needed. No unedited images will be released under any circumstances. 

Turnaround Time: Up to 7 days from your session gallery of proofs will be sent. You will choose your favorite images; Turnaround Time is 2- 3 weeks from the date you choose your favorite images and the final payment was made. Additional images are available to purchase $35 each.

Prints / Photo Products: Anna Fraczak Photography cannot be held responsible for the quality of the product when ordered from a third party direct by the client. Prints / Photo Products will need to arrange the pick up or additional shipping cost will be added.

E-mail list: Providing your email you agree to receive promotional emails with current deals or be the first to notify about special sessions. I won't spam you with every week email.

Data Protection: Anna Fraczak Photography will store Client names, contact details and session information privately and will not share these with any other business or organization.
